The case of a man charged with multiple drug and weapon possession charges is heading to trial after no resolution was reached.
A trial is scheduled to start on June 27 in the case Benjamin L. Cartwright II.
Cartwright, 39, is charged with multiple felonies including having weapons while under disability, improperly handling firearms in a motor vehicle, carrying a concealed weapon, possession of cocaine and aggravated possession of drugs stemming from a Feb. 8 incident.
During a final pretrial conference last Friday, the court was informed that both parties discussed a potential resolution, but were unable to reach an agreement and plan to proceed to trial.
On Feb. 8, local law enforcement officers were attempting to locate Cartwright to check on his well-being after it was reported he was upset and may be armed with a handgun and was driving with a suspended license. Police were also aware of a warrant out of the Clark County Common Pleas Court for a failure to appear charge.
Urbana police spotted and stopped a 1994 Chevrolet Cavalier Cartwright was driving in the 200 block of Miami Street. While taking him into custody, police recovered illegal drugs, included suspected cocaine, methamphetamine, prescription medications, marijuana, drug paraphernalia and cash.
Police also recovered a handgun under the driver’s seat along with additional drugs and drug paraphernalia.
On April 25, a motion requesting bond revocation was filed by Champaign County Assistant Prosecutor Samantha Whetherholt stating Cartwright violated his personal recognizance bond by possessing illegal controlled substances.
The motion states on April 19, Cartwright was arrested for possession of drugs.
A court statement filed in the Champaign County Municipal Court states on that date a Champaign County sheriff deputy and United States Secret Service agent responded to Cartwright’s residence in reference to a counterfeit money investigation.
Cartwright was placed into handcuffs and patted down during which a clear plastic bag containing fentanyl was found in his jeans. He admitted the fentanyl was his and he intended to use it.
Cartwright was indicted earlier this month for one count of aggravated possession of drugs, a fifth degree felony, for this incident.
A journal entry on the May 19 hearing notes the court will revisit the state’s motion once Cartwright’s guilt in the case is determined.
In the most recent case, Cartwright is being held in custody under on a $20,000 bond.
In addition to the two criminal cases in Champaign County, Cartwright is also charged in Logan County for possession of a controlled substance analog, carrying a concealed weapon with a specification, possession of LSD and illegal conveyance of drugs onto grounds of a detention facility.
